Mischa Barton has been charged with driving under the influence and possession of marijuana, stemming from her arrest in December, prosecutors announced Tuesday.
The former star of The O.C. was also charged with driving without a valid license. Her arraignment on the misdemeanor charges is set for Thursday in Beverly Hills Superior Court.
Barton, 22, was arrested for investigation of DUI in West Hollywood on Dec. 27 after her vehicle was seen straddling two lanes of traffic and she failed to signal when making a turn, police have said.

Planning to catch the Spice Girls on the next go-round? Don't hold your breath! That's the pessimistic prognosis from Geri Halliwell (a.k.a. Ginger Spice), who tells Billboard magazine that a reunion tour "probably won't happen ever again."
The group's Return of the Spice Girls World Tour finishes in Toronto on February 26 and that, she said, "is the last time you will ever get to see this Girl Power, the five Spices on the stage as one."
But would Halliwell – who notoriously split with the all-girl group in May 1998 – officially rule out performing again, if it's, you know, what fans really, really want? "What this reunion taught me is you can never say never," she told the music publication. No stranger to controversy, the actress used a vulgar word to describe a body part on Thursday morning's Today show – which later prompted a statement of apology from the program's cohost, Meredith Vieira.
Fonda and The Vagina Monologues playwright Eve Ensler were having a Valentine's Day conversation with Vieira about the 15th anniversary of Ensler's best-known work – and the 10th anniversary of "V-Day," founded by Ensler to end violence against women and girls around the world – when Fonda let the "c-word" slip.
"We were talking about The Vagina Monologues and Jane Fonda inadvertently said a word from the play that you don't say on television," Vieira said after a newsbreak on Today. The actress and single mom is set to star an untitled E! series which will follow her around as she “navigates Hollywood, romance and motherhood.” The show, which is being produced by Ryan Seacrest’s company, will debut in the summer.
But before the cameras even began rolling, Richards’s show has been in the headlines. The actress faced objections from ex-husband Charlie Sheen who was unhappy with her plans to feature their daughters Sam, 3, and Lola, 2, on the show. But in January, Richards was granted permission by a court commissioner to include her daughters in the show.

Britney's Mom: Sam Lutfi Drugged My Daughter
Britney Spears's mother accused Sam Lutfi of drugging the singer and verbally abusing her, according to a request for a temporary restraining order against Lutfi.
The request, which was granted, also gives a detailed description of the chaotic scene at Spears's house when her mother arrived Jan. 28 for an intervention, with Spears bizarrely talking like a "very young girl" and changing her clothes and her dogs' clothes "many times."
The restraining order, which forbids Lutfi from getting within 250 yards of Spears, her homes, her famlies' homes and the hospital where she's staying, alleges: "Mr. Lutfi has drugged Britney. He has cut Britney's home phone line and removed her cell phone chargers. He claims to control everything."
Lynne Spears's Allegations
In a six-page declaration, Lynne Spears says that when she and her friend Jackie arrived at her daughter's house, Lutfi – a constant companion of Britney – revealed he was giving her drugs.
"Sam told Jackie and me that he grinds up Britney's pills, which were on the counter and included Risperdol and Seroquel," Lynne says. [There appears to be no medication called Risperdol. Risperol is a sleeping medication, and Risperdal is an anti-pyschotic drug. Seroquel is prescribed to treat bipolar disorder.]
"He told us that he puts them in her food and that was the reason she had been quiet for the last three days," Lynne continues. "She had been sleeping. He told us that the doctor who is treating her now is trying to get her into a sleep-induced coma so that they could give her drugs to heal her brain."
Lutfi also demanded that Lynne do what he ordered, according to Lynne. "I'm the one who spends 24/7 with your daughter," Lynne quoted him as saying. "I sleep in cars outside her house so she can't leave." He then allegedly told Lynne: "You people throw everyone under the bus. If you don't listen to me I'm going to make your name s--- in the papers."
Lynne added that Lutfi "told me that if he weren't in the house to give Britney her medicine, she would kill herself. Then he said to me, 'If you try to get rid of me, she'll be dead and I'll piss on her grave."
Lynne claims that Britney and Lutfi had an argument earlier in the evening. "Sam had told Britney that she was an unfit mother, a piece of trash and a whore, that she cares more about [paparazzo] Adnan [Ghalib], her current boyfriend, than she cares about her kids, and that she does not deserve the kids."
Lynne says her daughter was acting strangely. "Britney ... became very agitated and could not stop moving," says Lynne. "She cleaned the house. She changed her clothes many times. She also changed her three dogs' clothes many times. Britney spoke to me in a tone and with the level of understanding of a very young girl. Britney then picked up a bottle of pills and read part of the label and asked us, 'What does insomnia mean?' Sam told her the pills will help her stay awake."
Three days after the scene at the house, Spears was hospitalized at UCLA Medical Center's psych ward and is under a 14-day forced hold. Her father Jamie Spears and a lawyer have been granted temporary control of her affairs.
Katharine McPhee Marries Producer Boyfriend
Singer-actress Katharine McPhee married producer Nick Cokas on Saturday in Beverly Hills, her rep Justin Gray Stone confirms exclusively to PEOPLE. The 23-year-old American Idol season five runner-up and Cokas, 42, exchanged vows in a late afternoon ceremony at Beverly Hills Presbyterian Church. "(Nick) is the love of my life," McPhee gushed to PEOPLE. "This is a once in a lifetime occasion and everything is just perfect."
McPhee wore a strapless ivory Manuel Mota gown and Neil Lane jewels (diamond and platinum chandelier earrings and diamond and platinum bracelets), while Cokas wore an Armani tuxedo. Fellow season five Idol contestants Kellie Pickler and Mandisa were among the 305 guests on hand for the nuptials.
Brandy's Mom: Kim Kardashian Abused My Credit Card
R&B singer Brandy Norwood's mother filed a lawsuit Monday against Kim Kardashian accusing her of running up more than $120,000 in credit card charges without permission.
The suit, which also names Kardashian's siblings Khloe, Kourtney and Robert Jr., alleges they ran up the charges on the mother's card in 2006 and 2007. It seeks the return of the money plus 10 percent interest.
In the lawsuit, Norwood's mother, Sonja Norwood, who is also her manager, alleges Kim Kardashian had only been authorized in 2004 to make one purchase on the Norwood American Express card in Kim's then-capacity as a stylist for Brandy (Brandy's brother, Ray J, also appeared in the infamous sex tape with Kim).
But later, Kardashian, made unauthorized purchases and passed on Norwood's card number to her siblings, who also then made unauthorized purchases, including for items in two Kardashian family-owned clothing stores, Dash and Smooch, for a total of $120,636.

Britney Spears is "on the edge" after discovering sex tapes were stolen from her Beverly Hills home. The troubled singer - who is currently undergoing psychiatric treatment at Los Angeles' UCLA Medical Center - is said to be terrified that "valuable items" taken from her sprawling mansion on Friday night (01.02.08) included X-rated footage of her taking drugs and having sex.
This would not be the first time Britney has been involved in a sex tape scandal.
Footage apparently showing the singer performing oral sex on ex-husband Kevin Federline was leaked on the internet last year, but was eventually classed as fake. More recently, there were reports of Britney, 26, starring in another sex tape where she sported a shaven head and performed a sex act on two women and a man while consuming cocaine and marijuana. However, the footage was never made public.
Meanwhile, Britney - who was involuntarily committed to the Stewart and Lynda Resnick Neuropsychiatric Hospital at UCLA last week after being classed as G.D. (gravely disabled) - will now spend an additional 14 days in the ward, after her psychiatrist deemed she wasn't well enough to leave.

The former 'Baywatch' actress will perform four times at Paris' Le Crazy Horse cabaret club on February 13 and 14, after club owner Andree Diessenberg saw her assisting magician Hans Klok in his Las Vegas show last year.
Diessenberg told People magazine: "Pamela chose the dates herself. But when I saw her onstage, I said to myself right away, 'I have to put her onstage.' What a knockout!
"Pamela will perform a Brigitte Bardot tribute number entitled 'Harley Davidson' and will also appear in the finale."
Le Crazy Horse is a cabaret club situated on the expensive Avenue George V in France's capital city. After opening in 1952, it quickly became known as the 'Temple of Nudity' because of its completely naked policy.
The club is frequented by many stars. Burlesque queen Dita Von Teese regular performs, while Jay-Z and Beyoncé Knowles treated themselves to a private visit for Jay-Z's 38th birthday last year.
Mother-of-two Pamela is said to be "in discussions" about whether or not she will appear fully nude in the finale.
